We are committed to protecting the privacy of your personal and identifiable information as you use this website and services provided. This Privacy Policy tells you how we protect and use information we gather from you. By using this website, you consent to the terms described in the most recent version of this Privacy Policy. Reading our Terms and Conditions, and our Disclaimer will give you even further understanding of the general rules about your use of this website, and any additional terms that may apply when you access particular services or materials with Mama Gives Birth, LLC. 

This Privacy Policy (herein referred to as “Policy”) explains how Mama Gives Birth, LLC (herein referred to as the “Company,” “we,” “us,” or “our”) processes Personal Data that we collect from you (herein referred to as the “subscriber, user, you, or your”) as a Controller.

 

1. DEFINITIONS.

(a) “Controller” means the natural or legal person, public authority, agency, or other body, which alone or jointly with others, determines the purposes and means of processing Personal Data.

 

(b) “Personal Data” means any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 

(c) “Service(s)” means any service option of Doula Support, and Childbirth Education including our Mama Gives Birth Course.

(i) “Subscriber” means the natural or legal person who has subscribed to the Service(s) by agreeing to the Terms.

(ii) “Terms” means the binding contract between the Company and Subscriber that governs the Subscriber's access and use of the Service(s).

 

2. DATA COLLECTION.

 

(a) The Subscriber directly provides the Company with most of the data we collect. The Company collects Personal Data from the Subscriber from the following sources: when you fill out and submit our website contact form and provide your name, email address, due month, services interested in, and other personal information health related or not that you deem necessary to include, when you provide your name and email for our email subscription form, or when you conduct a purchase transaction with us and provide personal information in support of a transaction such as your address, your telephone number and your credit card information.

(b) Non-personal information is information that cannot identify the Subscriber. When the Subscriber visits this web site to read information, such as information about our services, we may collect certain non-personal information about the Subscriber from the Subscriber's computer’s web browser. Because non-personal information cannot identify the Subscriber or be tied to the Subscriber in any way, there are no restrictions on the ways that we can use or share non-personal information. 

3. PROCESSING OF PERSONAL DATA.

 

(a) The Company may keep and processes the Subscriber’s Personal Data to provide user with access to products or services, to contact and communicate with user in response to booking inquiries or service requests or to answer questions or comments, to bill or invoice user for products or services user purchased, to connect with user on Zoom for services, and to provide ongoing service and support through personalized marketing emails or to ask the user of an opinion or testimony about our services for record keeping and analytical purposes and to research, develop and improve programs, products, services and content.

 

(b) The Company will generally collect Personal Data from Subscribers only where it needs to create a contract with the Subscriber, where the processing is in the Company’s legitimate interests and not overridden by the Subscriber’s data protection interests or fundamental rights and freedoms, or where the Company has the Subscriber’s consent. In some cases, the Company may also have a legal obligation to collect Personal Data from the Subscriber.

 

(c) If the Company processes Personal Data with the Subscriber’s consent, the Subscriber may withdraw their consent at any time.

4. SHARING OF PERSONAL DATA.

 

(a) The Subscriber acknowledges that the Company may share the Subscriber’s Personal Data with its group companies and third-party service providers to offer the Subscriber the Company’s Service(s) and/or send information or updates about the Service(s).

 

(b) When the Company processes the Subscriber’s purchase for services, it may send the Subscriber’s Personal Data and use the resulting information from credit reference agencies to prevent fraudulent purchases.

 

(c) The Company shares Personal Data in the following instances for marketing purposes, testimonials, and reviews and ratings on any affiliated Mama Gives Birth, LLC social media platform (Instagram, Facebook, website, online review and rating forms including Google reviews and ratings and Facebook reviews, recommendations, and ratings).

5. RETENTION OF PERSONAL DATA.

 

(a) Company retains the Personal Data when an ongoing legitimate business requires retention of such Personal Data.

 

(b) In the absence of a need to retain Personal Data, the Company will either delete or aggregate it. If this is not possible, the Company will securely store your Personal Data and isolate it from any further processing until it is deleted.

(c) The Company may be legally compelled to release your personal information in response to a court order, subpoena, search warrant, law or regulation.

(d) The Company may cooperate with law enforcement authorities in investigating and prosecuting website visitors who violate our rules or engage in behavior, which is harmful to other visitors or is illegal. We may disclose your personal information to third parties if we feel that the disclosure is necessary to protect our rights or property, protect someone's health, safety or welfare, or to comply with a law or regulation, court order or other legal process. 

6. SECURITY OF PERSONAL DATA.

 

(a) The Company uses appropriate technical and organizational measures to protect the Personal Data it collects and processes. These measures are designed to provide a high level of security appropriate to the risk of processing the Subscriber’s Personal Data. If you are a Subscriber and have any concerns about the security of your Personal Data, please contact us immediately.

(b) Only authorized personnel and third party vendors have access to Subscriber's personal information, and these employees and vendors are required to treat this information as confidential. Despite these precautions, we cannot guarantee that unauthorized persons will not obtain access to Subscriber's personal information.

(c) We may contact the Subscriber periodically by email, mail or telephone to provide information regarding services and content that may be of interest to you. We cannot guarantee that our contact with the Subscriber will be secure from unauthorized interception.

7. MODIFICATION.

 

The Company keeps this Policy under regular review and may update this webpage at any time. This Policy may be amended at any time, and a notice will be included on the homepage of the website for a period of time only if there are material changes to this Policy.
